The Work Made for Hire Conundrum
Further, consider the situation wherein an independent producer is hired by the record company to produce an artist already under contract to the record company in which the producer is responsible for all creative decisions and who engages all other personnel rendering services in the recording process.
In those cases, it is the producer who engages the artist, musicians and engineers, background singers and is the final arbiter of the creative product that is delivered to the record company.
The first chapter in this struggle came to a close in October 2000 as a draw, with Congress repealing the amendment in response to concerns voiced by the artist community that artists’ rights would be severely injured should the record companies’ amendment permit sound recordings to be recast as works made for hire.

 Record Producer Deals
Many years ago, record companies used to negotiate with and hire producers to produce records for the artists until they realized that their legal department was spending too much time, money, and intellectual capital on such mundane deals.
The role of a record producer in the creation of a recording is similar to that of a movie director to a motion picture.
That is, the record producer is primarily responsible for managing the creative process by screening and selecting songs for the artist(s) to record, getting just the right vocal performance and deciding the musical arrangements.

Amazon.com: Music: How To Dismantle An Atomic Bomb (Deluxe) [ENHANCED] [LIMITED EDITION]
In the pre-release press, much was made of the producer shuffle on this record, as U2 ultimately tagged Steve Lillywhite, the original producer of their first three records (1980-1983).
Of course, the profile of that record, and in particular, the uplifting singles "Stuck in a Moment" and "Walk On", straddling the fence between the realm of classic U2 and the stereotype knee-jerk anthems, were undoubtedly boosted by 9/11.
Enter Steve Lillywhite, the band's original producer and sometime collaborator in the decades since, who helped retool the track "Native Son" (originally an anti-gun screed) into the aggressive i-Pod anthem "Vertigo" and leaves his distinctive stamp on the muscular "All Because of You" and others.

Record producer - Wikipedia, the free encyclopedia
In the first half of the 20th century, the record producer's role was comparable to that of a film producer, in that the record producer organised and supervised recording sessions, paid technicians, musicians and arrangers, and sometimes chose material for the artist.
Until the 1960s most producers and AandR directors were salaried staff on the payroll of major record labels, and most recordings were made at studios owned and operated by major record labels, such as the famous EMI Abbey Road Studios in London.
This change was facilitated by the introduction of high-fidelity magnetic tape recording technology in the mid-1950s, which dramatically altered the processes and economics of music recording.

HOW TO BECOME A RECORD PRODUCER
I think the best way to discover exactly how a record producer earns a living is to look back in history to a stage where a recording was seen as a live performance captured on vinyl, rather than the studio constructions that are now the norm.
The freelance producer will be paid by the record company (who will get that money back from the band's share of the eventual profits), and he is then free to go on to work for another record company.
The producer must be capable of exercising a degree of control to shape the band into something that will work on CD as well as it does on stage.
